Terms of Service

Welcome to PayPig Canada ("the Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of paypigcanada.com and our mobile application. By creating an account or using the Platform, you agree to be bound by these Terms in full.

If you do not agree to these Terms, you must not access or use the Platform.

1. Eligibility

You must be at least 18 years of age to use PayPig Canada. By registering, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into a binding agreement;
• You are not prohibited from using the Platform under any applicable law;
• All information you provide during registration is accurate and truthful.

2. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@paypigcanada.com if you become aware of any unauthorised use of your account.

You may not create accounts using automated means or under false pretences. PayPig Canada reserves the right to suspend or terminate accounts that violate these Terms.

3. Community Standards & Prohibited Conduct

PayPig Canada is a community built on consent, respect, and mutual agreement. All users must adhere to the following standards:

• All financial exchanges on the Platform must be freely and fully consensual;
• You must not harass, threaten, coerce, or manipulate other users;
• You must not impersonate any person or entity;
• You must not use the Platform for any unlawful purpose;
• You must not post, share, or transmit content that is non-consensual, illegal, or harmful;
• You must not attempt to circumvent the Platform's safety or payment systems;
• You must not solicit users to transact outside the Platform's secure payment system in order to avoid fees.

Violation of these standards may result in immediate account suspension or termination, and may be reported to relevant authorities where required by law.

4. Financial Transactions & Tributes

All financial transactions conducted through the Platform are between users and are voluntary. PayPig Canada acts as a facilitator and is not a party to any financial relationship between members.

• All payments are processed through our secure, third-party payment processor;
• PayPig Canada charges a platform service fee on transactions (see current fee schedule in the app);
• All tribute transactions are final and non-refundable unless the recipient violated these Terms;
• Users are solely responsible for any tax obligations arising from payments received.

5. Subscription Plans

PayPig Canada offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually as selected at time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. You may cancel your subscription at any time through the app settings.

Refunds for subscription fees are not provided except where required by applicable Canadian consumer protection law.

6. User Content

By posting content on the Platform, you grant PayPig Canada a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your content for the purposes of operating and promoting the Platform. You retain ownership of your content.

You are solely responsible for the content you post. You must not post content that is illegal, non-consensual, defamatory, or that violates any third party's intellectual property rights.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

8. Disclaimers & Limitation of Liability

The Platform is provided on an "as is" and "as available" basis without warranty of any kind. PayPig Canada does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, PayPig Canada shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.

9. Indemnification

You agree to indemnify and hold harmless PayPig Canada, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Platform, your User Content, or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
